Q: If a family sues our school, is there any coverage under our D&O policy?

A: Yes, probably. Unless your school is accused of willful and criminal intent (we don’t see many of these claims), the answer is yes.

Directors and Officers (D&O) insurance is designed to protect the school against claims of negligence, i.e., the school (administration, faculty, and staff) is accused of doing something they should not have done or failed to do something they should have done.

The better D&O polices will cover third party claims, including those from parents who may sue for failure to educate, wrongful discipline, failure to provide a safe environment, etc.
